Rasim Delic, former Commander of the Main Staff of BiH Army is on trial before ICTY. The indictment charges Rasim Delic with four counts of violations of the laws and customs of law.

Acording to the indictment, Rasim Delic, assuming the post of Commander of the Main Staff of BiH Army de facto and de jure exercised military command and control over the BiH Army which was involved in crimes alleged in the indictment. Rasim Delic was also aware and informed that members of biH Army from the “Al Mujahid” unit were prone to committing crimes, especially crimes against captured civilians and that the  “Al Mujahid”  unit was operating in the “Kamenica” camp.

After the analysis of the indictment, the Secretariat established that the indictment against Rasim Delic does not include criminal case made by the County Prosecution Office in Doboj (with the evidence). According to this indictment, Rasim Delic is held responsible for wanton shelling of Doboj, Modrica, Teslic and Petrovo  from June 1993 until November 1995.

Namely, in November 2002 this case was transferred to the “Rules of the Road” unit. Upon the request made by the Secretariat, in May 2005 the “Rules of the Road” unit sent a reply that this case had not been reviewed by this unit.

Regarding this matter, the Secretariat in correlation with the institutions on power in RS has been working on collecting the evidence that could be used by the Prosecutor during the trial.

Therefore, at the next meeting with the senior trial attorney expected at the end of August, the Secretariat is going to suggest that ICTY Prosecution office acknowledge the evidence from the County Court Doboj in order to extend the indictment against Rasim Delic so that his responsibility for criminal act of violations of the law and customs of war (shelling civilians) be established.
