How to get information - Application Guide

GUIDE

on procedure for access information in the Center for War Crimes Research

1. Every physical and jurist person has right to submit request for access information that are under competence of Republic Center for (in further text referred as the Center).

2. Request is submitted in written form to the Center, via post or by direct delivery in the office for receiving mails of the Center.

3.Request has to be clear and has to contain sufficient information regarding nature and context of wanted information.

4.If physical person submits request, they are obliged to prove identity with personal documents.

5. If legal agent submits request, he/she is obliged to prove identity and the proof is accreditation signed by authorized person.

6. After receiving request, the Center is obliged, through its officer for public relations and information, to review facts and circumstances that are important for processing request.

7. The Center is obliged to inform an applicant if access to information is approved, partly or completely in period of 15 days after receiving request. Time can be extended for seven days in cases as described in the Law on Freedom to Access Information (Official Gazette RS number 20/01).

8. Access to information will be provided to applicant on one of the official languages of Bosnia and Herzegovina, as well as on the original language that is different from the official languages if possible.

9. The Center can deny a request for access information, partly or completely for next categories of information:

When it can be reasonably expected that it will cause significant damage to legitimate goals for next category of information:

- interests of defense and security and protection of public safety,

- preventing crime and every divulgence of crime,

- protection of process in reaching decisions determined by law,

- when a request for access information includes classified commercial interests of the third side,

- when a request for access information includes personal interests that are referred on privacy of the third side,

- when, after conduced proceeding, it is established that published information is not of public interest.

10. If the Center does not have a possibility to satisfy request, then, in the period of eight days it will inform an applicant of request with instruction about opportunity to appeal to competent agency, including the right to appeal to the Ombudsman of Republika Srpska.

11.Public relations and proceeding under request of physical and jurist persons for access information in the Center will do officer for public relations and information. He/she will be appointed by decision of Head of the Center.

12.The Center will have separate index register about kind of information that are under control.

13. Expenses of copies of information are determined by Instruction on expenses of copies of materials (Official Gazette RS number 64/01), where it is determined that 10 standard sizes of copies are free of charge. Applicant of request for copies of materials that contains more than 10 pages will pay 20 pfennig per page. Copying of materials will do competent public agency that has control under requested information.

14.Integral part of this Guide is a form for application for request for access information.
